January 27, 2015 <br />Page 5 <br />Title XV Land Usage, Chapter 152 Zoning Code, Section §152.203 ALLOWED USES states that, "in <br />some unique situations, the PUD may allow the approval of use or uses that are not listed as either <br />permitted or conditional uses in any underlying zoning district. The specific allowed uses and <br />performance standards for each PUD shall be delineated in an ordinance and development plan. The <br />PUD development plan shall identify all the proposed land uses, which shall become permitted uses <br />if the final development plan is approved. Any change in the uses presented in the final <br />development plan will be considered an amendment to the PUD and must follow the procedures <br />specified in this subchapter." <br />RECOMMENDED ACTION <br />1. Approval (with or without modifications) of the PUD Ordinance. In the event of a decision to <br />approve (with or without modifications) the Applicant's request, the City Council may refer to <br />Exhibit C and may modify the draft ordinance to include any performance standards that it <br />deems necessary. <br />2. Denial of the PUD Ordinance.
