CITY OF ST. ANTHONY VILLAGE <br />HENNEPIN COUNTY, MINNESOTA <br />RESOLUTION 14-086 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT (CUP) TO ALLOW A <br />RESTAURANT TO BE LOCATED LESS THAN 250 FEET FROM A RESIDENTIALLY <br />ZONED DISTRICT AND A VARIAN CE FROM THE MINIMUM REQUIRED PAR.KING <br />STALLS ON THE PROPERTY LOCATED AT 2510 KENZIE TERRACE <br />WHEREAS, the City of St. Anthony Village received a request from the Applicant Joel <br />Janssen on behalf of the Owner R.J. Ruppert Trustee for a conditional use permit (CUP) to allow <br />a restaurant to be located less than 250 feet from a residentially zoned district and a variance from <br />the minimum required parking stalls on the property located at 2510 Kenzie Terrace on October <br />14, 2014, legally described as follows: <br />Lot 2, Block 1, KENZIE TERRACE ADDITION <br />WHEREAS, the Property located at 25 l 0 Kenzie Terrace is located within the C- <br />Commercial Zoning District; and <br />WHEREAS, restaurants, cafeterias and delicatessens located Jess than 250 feet from a <br />residential structure or district are permitted conditional uses with the issuance of a Conditional <br />Use Permit (CUP) in the C-Commercial Zoning District; and <br />WHEREAS, the Property located at 2510 Kenzie Terrace is located immediately <br />adjacent to a residentially zoned district; and <br />WHEREAS, the site currently has 37 marked parking stalls for shared use between the <br />two buildings (and three uses) on the Property; and <br />WHERAS, the proposed restaurant use requires 42 parking stalls for a total of 53 parking <br />stalls when combined with the other uses existing on site; and <br />WHEREAS, the Planning Commission reviewed and considered the requests based on <br />the related documents shown in the Applicant's application in a public hearing at their regular <br />meeting on November 24, 2014; and <br />NOW THEREFORE BE IT RESOLVED that the City Council of the City of St. <br />Anthony Village approves the Applicant's conditional use permit and variance requests based on <br />the following findings: <br />I. The requested conditional use permit (CUP) is consistent with all of the standards for <br />granting a conditional use permit as described in Section § 152.243 of the St. Anthony <br />Village Zoning Code. More specifically, the City Council finds that the required <br />conditional use permit is justified for the following reasons: <br />a. The restaurant use is one of the conditional uses specifically listed within the C- <br />Commercial Zoning District in which the Property is located in. <br />b. The City has specified all conditions which the City Council has deemed <br />necessary to make the use compatible with other uses in the area; <br />69
