WHEREAS, the Watershed District, by Resolution 2014 -20, accepted the amended joint <br />petition and directed further proceedings for project 2013 -01 consistent with the <br />amended petition; <br />WHEREAS, the City and Watershed District have worked cooperatively to develop goals and <br />objectives for the Mirror Pond project component, a concept construction design <br />for the project, a cost allocation between the City and the Watershed District for <br />construction of the project, and a plan for maintenance of the project, once <br />constructed; <br />WHEREAS, the City and the Watershed District agree that the City's preferred alternative <br />(noted as Alternative 5 in the Mirror Pond Conceptual Design Memorandum, <br />prepared by Houston Engineering, Inc., and dated May 6, 2015) will meet <br />performance standards required by the Grant; and <br />WHEREAS, prior to expending funds under the Targeted Watershed Demonstration Grant, the <br />Grant Agreement requires that the City provide the Watershed District assurances <br />regarding construction of the project using grant funds, design and performance <br />standards for the project, access agreements on City property for the purpose of <br />inspecting or correcting damage to the project, and maintenance of the project. <br />NOW, THEREFORE, BE IT RESOLVED, the City Council approves the attached <br />Cooperative Agreement and authorizes its execution by the Mayor and City Clerk; and <br />FURTHER, The City Council directs staff to coordinate with the Watershed District and City <br />Engineer to define the scope and duration of access agreements described in the Cooperative <br />Agreement. <br />Adopted the 25`h day of Ate, 2015 <br />erome O.
