Page 2 <br />City Council 1st Reading <br />June 9, 2015 <br /> <br />3) Adding a clause to allow the continuation of existing solar systems, unless an upgrade requiring <br />a building permit is proposed; <br />4) Clarifying the structural integrity requirement to add “to the satisfaction of the building <br />inspector” <br />5) Referencing conditional use permit criteria in city code; <br />6) Eliminating the requirement for a licensed contractor- allow homeowner to install, with the <br />issuance of a building permit. <br />The City Council held a work session on May 4, 2015 and again reviewed the revised ordinance. They <br />accepted the recommended changes of the Planning Commission and recommended the following <br />additional changes: <br />1) Solar energy systems on accessory structures must be flush mounted; <br />2) Any solar installation mounted to a light pole shall not exceed three (3) square feet. <br /> <br />The Planning Commission held a public hearing on May 18, 2015, and no one spoke on the draft <br />ordinance. They recommended approval to the City Council, with minor edits, which are reflected in the <br />attached ordinance. <br />SUMMARY OF ORDINANCE AMENDMENTS <br />As proposed, the ordinance makes the following changes from the original solar ordinance: <br />1) Adds a clarifying definition of “flush mounted solar energy systems” <br />2) Clarifies and expands the purpose of the ordinance <br />3) Allows for solar panels in residential districts and required standards <br />4) Requires conditional use permit for all commercial installations <br />5) Added a caveat about ready roof access for emergency access <br />6) Requires proof of structural integrity to the satisfaction of the building inspector <br />7) Allows free standing solar energy systems in the rear yards of residential, with applicable <br />standards, including double the side yard setback <br />8) Added specific standards for lightpoles <br />9) Added design and performance standards for solar energy systems <br />RECOMMENDED ACTION <br />Staff recommends approval of the enclosed ordinance amending Sections 152.008 and 152.187 of City <br />Code to incorporate revised standards for solar energy systems. <br /> <br /> <br />32
