COOPERATIVE AGREEMENT BETWEEN <br />THE CITY OF ST. ANTHONY AND THE RICE CREEK WATERSHED DISTRICT <br />FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF <br />THE MIRROR POND PROJECT COMPONENT OF <br />THE PETITIONED BASIC WATER MANAGEMENT PROJECT 2013-01 <br /> <br />THIS AGREEMENT, made and entered into this ___ day of _________, 2015, by and between <br />the City of Saint Anthony, Minnesota, a municipal corporation (hereinafter “City”) and the Rice <br />Creek Watershed District, a special purpose unit of local government under Minnesota Statutes <br />Chapters 103B and 103D (hereinafter “District”). <br />WHEREAS, on July 23, 2013, by Resolution 13-056, the City Council approved a joint petition to <br />the District for a Basic Water Management Project to address stormwater management and <br />flooding within the Cities of New Brighton and Saint Anthony; <br />WHEREAS, on August 28, 2013, by Resolution 2013-23, the District’s Board of Managers <br />initiated the Project, assigning Project Number 2013-01, and appointed Houston Engineering, <br />Inc. as the Project Engineer to make surveys, maps, analyses and reports for the Project as <br />necessary and consistent with the Project phasing, coordination and implementation proposals <br />contained within the Petition; <br />WHEREAS, phase 1 of the Project phasing, coordination and implementation proposals <br />contained within the Petition was completed and the Project Engineer submitted a Phase 1 <br />Report dated March 31, 2014; <br />WHEREAS, the Phase 1 Report identified the Mirror Pond project component (hereinafter <br />“Improvement”) as a key feature within the City to achieve project objectives and as ready for <br />immediate implementation; <br />WHEREAS, the Improvement is identified in the City’s July 2011 Flood Investigation and <br />Stormwater Modeling Report; <br />WHEREAS, during the phase 1 proceedings, the District, in cooperation with the City, submitted <br />a Targeted Watershed Demonstration Grant (hereinafter “Grant”) proposal to the Board of <br />Water and Soil Resources (hereinafter “BWSR”) which included the Improvement; <br />WHEREAS, the District was successful in its proposal and has received a Grant to be used to pay <br />the cost of various projects, including implementation of the Improvement as part of the <br />petitioned Basic Water Management Project; <br />WHEREAS, the Cities of New Brighton, Saint Anthony and Roseville filed a joint petition, duly <br />authorized by the governing bodies of the Cities upon resolutions of the City Councils, to amend <br />Project 2013-01 to allow implementation of the Improvement without delay; <br />1515
