Application for Variance to the City of St. Anthony <br />Jeff and Nona Carlson <br />2926 Armour Terrace <br />St. Anthony, MN 55418 <br />St. Anthony — Land Usage: <br />The subject matter of the application is within the scope of this section. We are <br />requesting a variance in order to install an in -ground pool on our property at 2926 <br />Armour Terrace. <br />Strict enforcement of the land use ordinance would cause practical difficulties because <br />we propose to use the property in a reasonable manner not permitted by the zoning code. <br />Our property at 2926 Armour Terrace, through no efforts of our own, has already <br />exceeded the maximum amount of impervious surface allowed on a single lot (35%) for a <br />single-family home in St. Anthony. <br />The plight of the property owners is due to circumstances unique to the property not <br />created by the property owners. The existing footprint of our property, as well as the <br />subsequent sidewalk and driveway, were established in 1955 when our home was built <br />and the ordinance was passed in 2008, three years after we purchased the property in <br />2005. <br />The variance, if granted, will not alter the essential character of the locality, and in fact, <br />will improve the essential character and quality by increasing the value of our home, <br />which in turn increases the property value of the surrounding homes in the neighborhood. <br />We have hired an architect who has developed a comprehensive plan to include <br />landscaping, green areas, and pervious patio surface in order to maximize ground water <br />retention and minimize run-off. <br />Economic considerations are not at all the basis of the practical difficulties. <br />The variance, if granted, would be consistent with the city's comprehensive land use plan <br />and is in harmony with the general purposes and intent of the zoning code in that we, the <br />property owners, will create pervious space around the pool wherever possible and <br />necessary. Due to continuous drainage issues on our property, which necessitated a sump <br />pump installation last fall, we originally planned to pour concrete over much of the area <br />around the pool*, allowing for landscaping and green space. After being made aware of <br />the city's ordinance, however, we had our design modified to include pervious pavers. <br />(See attached plan.) <br />*A minimum bib of three feet of concrete is required around the perimeter of the pool. <br />Five feet is recommended for support, stability, and longevity of the pool. <br />
