-2- <br /> CLASSIFICATION LAND-`USES REF FEE <br /> 2 Schools and Institutions 1.25 $16.25/acre <br /> 3 Multiple family residential, <br /> churches and governmental 2.50 $32.50/acre <br /> buildings <br /> 4 Commercial 5.00 $65.00/acre <br /> For the purpose of calculating storm water drainage fees, all developed one family <br /> and duplex parcels shall be considered to have an acreage of one-fourth (1/4th) <br /> acre. <br /> 3.604 Credits. Property owners who apply for a reduction in fees due to <br /> on-site facilities which improve water quality or reduce its outflow rate must <br /> apply for a variance paying the usual variance request fee. A city engineer will <br /> review the site and make a recommendation to Council. There will also be a cap <br /> of 25 percent (25X) . Any adjustments of storm water drainage fees shall not be <br /> made retroactively. <br /> 3.605 Payment of Fee. Statements for storm water drainage fee shall be <br /> computed every three (3) months and invoiced with the sanitary sewer statement <br /> and shall be due and payable with same. Any prepayment or overpayment of charges <br /> shall be retained by the City and applied against subsequent quarterly fees. <br /> Whenever possible any rate increases will be based on the index from the <br /> Engineering News Report, a public hearing will always be required, and rate <br /> increases will be made by resolution. Any properties being presently assessed <br /> for storm sewer or have been assessed for storm sewer in the past ten (10) <br /> years will receive 1C0 percent (100X) drainage utility fee abatement for the <br /> f irst four (4) years, will be charged- fifty percent (50%) of the drainage <br /> utility fee in the fifth year, with an additional ten percent (10X) of the <br /> total fee each additional year until the amount reaches the full fee with <br /> full participation to be reached in the tenth year. For future storm <br /> drainage projects (after January 1, 1987 the Council will determine <br /> the abatement formula at the time the project is ordered. <br /> 3.606 Penalty for Late Payment. Each quarterly billing for storm water <br /> drainage fees not paid when due shall incur a penalty charge of ten percent <br /> (10X) of the amount past due. <br /> 3.607 Certification of Past Due Fees on Taxes. Any storm water drainage <br /> fees past due on October 1 of any year may be certified to the County Auditor <br /> for collection with real estate taxes in the following year pursuant to Minnesota <br /> Statutes, Section 444.075, Subdivision 3. In addition, the City shall also have <br /> the right to bring a civil action or to take other legal remedies to collect <br /> unpaid fees. <br /> This Ordinance shall be in full .force and effect January 1, 1987. <br />
