Lessor and Lessee - agree <br /> that the�' signs described on Exhibit B may be installed by Lessee. <br /> at its expense. Lessee shall not place or permit to be placed in <br /> any portion of the demised premises any fixtures, equipment or <br /> materials the weight of which is in excess of the reasonable or <br /> safe carrying capacity of the Building. <br /> 4. CONDITION OF PREMISES; RELEASE OF LESSOR. <br /> Lessee acknowledges the receipt of the demised premises <br /> and the same to be in tenantable condition, and acceptable to the <br /> Lessee, - and in the condition in which they were represented to <br /> the Lessee to be and agreed to be put in by the Lessor; and the <br /> Lessee hereby releases the Lessor from any and all claims arising <br /> from any defects known to Lessee in the condition of said demised • <br /> premises, or the equipment, fixtures or appliances in or serving <br /> said premises. <br /> 5. SUBLEASING. <br /> Lessee agrees that it will not sublet the demised <br /> premisesu or any part thereof, and will not assign this Lease or <br /> any interest therein, nor permit such Lease to become transferred <br /> by operation of law or otherwise, and that no act or acts will be <br /> done or suffered whereby the same may be or become sublet or <br /> assigned in whole or in part. Lessee agrees that the restaurant <br /> will be operated by Lessee and Lessee only, and that it will not <br /> contract with anyone else for the operation or management of the <br /> restaurant. Lessee shall not sell, assign or otherwise transfer <br /> a controlling interest in the stock of Lessee without Lessor' s <br /> prior written consent. Lessee contemplates the formation of a <br /> new Minnesota corporation for purposes of the operation of this <br /> restaurant - and for purposes of this paragraph and any other <br /> provisions ' pertaining to assignment contained herein, the • <br /> assignment of this Lease-- from Manning ' s.
