No approval by the,.HRA. shall relieve Redeveloper of • <br /> the :obli•gation to comply .with. the 'terms of :this - Agreement, the. <br /> :terms- of the Redevelopment :Plan, applicable federal, state and <br /> local l-aws, - ordinances,.•, rules and regulations, -or- to properly <br /> demolish. the. existing buildings or construct the Minimum - <br /> Improvements . No approval by the HRA shall constitute a waiver <br /> of an Event of Default . Any disapproval of the Construction <br /> Plans shall set forth the reasons therefor, and shall be made i <br /> within 60 days after .the. date of their receipt by the HRA. If ` <br /> HRA rejects the Construction Plans, in whole or in part, <br /> Redeveloper shall submit new or corrected Construction Plans <br /> within- 30 days .after wr'it.ten notification to Redeveloper of the <br /> rejection. The provisions of this Section relating to <br /> approval, rejection and resubmission of corrected Construction <br /> Plans shall conti-nue to apply until the Construction Plans have <br /> been approved by HRA. <br /> Section 4 . 3 _Commencement and Completion of <br /> Construction. <br /> (a) As soon as reasonably possible after conveyance to <br /> Redeveloper, Redeveloper shall have the existing buildings on <br /> the property demolished and shall have all debris removed, all <br /> in accordance with the HRA' s demolition specifications . <br /> Redeveloper will thereafter provide the HRA with a statement in <br /> form and detail reasonably satisfactory to the HRA showing the • <br /> costs of such work . HRA shall reimburse Redeveloper for such <br /> costs , but payment of such demolition costs by the HRA shall <br /> not exceed $90 , 000 . No reimbursement shall be made until all <br /> . demolition -and debris removal has been completed. <br /> (b) Subject to Unavoidable Delays, Redeveloper shall <br /> commence construction according to the Time Table or on such <br /> other date as the parties shall mutually agree . Subject to <br /> Unavoidable Delays , Redeveloper shall complete construction of <br /> the Minimum Improvements in accordance with the Time Table . <br /> All ,work with respect to the Minimum Improvements shall be in <br /> conformity with the Construction Plans approved by the HRA. <br /> Redeveloper shall promptly begin and diligently prosecute to <br /> completion -the redevelopment of the Redevelopment Property <br /> through the construction of the Minimum Improvements . <br /> Redeveloper shall' make reports , in such detail and at such <br /> times as may reasonably be requested by -the HRA, as to the <br /> actual progress of- Redeveloper with respect to construction of <br /> the Minimum Improvements . <br /> (c) Redeveloper shall not interfere with, or construct <br /> any improvements over, any public street or- utility easement <br /> without -the -prior written approval of the City.. - All <br /> connections to public- utility lines and- facilities shall be <br /> • <br /> -10- <br />
