� ~ ; 7 . That ACM shall provide euthanasia service to CITY at no <br /> additional charge . Said service shall be administered by <br /> qualified personnel and the disposal of animal carcasses <br /> shall be performed as required' by Minnesota Statute <br /> • Section '35 . , at' no additional charge as long as current <br /> rendering facility is operational . A charge for disposal ' <br /> would- be open to negotiation at , t•hat time . <br /> 8 . That: .-.CM shall assume all liability for all harm to <br /> persons , animals and .property due to its negligence or <br /> the negligence of thi's contract , and agrees to defend <br /> the performance of this contract ', and agrees to ; defend <br /> any legal actions arising therefrom . . ACM shall hold CITY <br /> harmless and provide CITY with proof of public liability <br /> coverage , ' in the amount of $200 , 000 per each <br /> claimed and $600 , 000 for each occurrence , . covering the <br /> performance of this contract . Further , ACM will furnish <br /> the 'CITY a certificate of insurance evidencing statutory ' j <br /> Worker ' s Compensation .coverage for all ACM employees . <br /> 9 . That during the duration of this contract ACM shall <br /> not , within the State of -Minnesota , discriminate against <br /> any employee or applicant for employment because of race, <br /> color , creed , natinal 'origin , or ancestry and shall include <br /> a similar provision in all subcontracts entered into for the <br /> performance hereof , this paragraph being. to comply with the <br /> provisions of Minnesota StaLuLe ' Sect'ion 181 . <br /> 10 . That ACM shall keep accurate and detailed records of ' the <br /> impounding and disposition of all animals picked up in <br /> CITY and furnish monthly reports to CITY ' as to the services. <br /> performed during the month . That ACM shall provide <br /> • uniformed Animal Control Officers and marked vehicles . <br /> AND CITY , in consideration of said 'coventants and agreements of <br /> ACM hereinbefore contained , hereby coventants with ACM that CITY will <br /> obtain Animal Control Service from ACM pursuant to ' the following <br /> provisions : <br /> 11 . This Agreement shall cover the period from October 1 , 1987 <br /> to December 31 , 1987 and for one year thereafter com- <br /> mencing January 1 , 1988 and ending December 31., 1988. <br /> This agreement shall be automatically renewable from year' <br /> to year on the last business day of December unless either <br /> party gives notice 90 days prior to the expiration date <br /> that it intends not to renew the Agreement . On or before , <br /> July 15.th ACM will submit new proposals to CITY for consid- <br /> eration . . <br /> 12 . That CITY shall pay to ACM the sum of $ 462 per <br /> month for Animal Control Service for the period from <br /> October 1 , 1987 through December 31 , 1988. <br /> 13 . That all boarding fees for claimed animals shall be <br /> retained by ACM . CITY shall pay a boarding fee in <br /> the amount of $10 . 00 for each unclaimed animal . <br /> i <br />
