08/16/00 WED 15:33 FAX 6123402644 DORSEY & WHIMY _- - <br /> 18 <br /> • Dr4- 1: 8/16/00 <br /> PLANNED UNIT DEVELOPMENT AGREEMENT <br /> This Agreement is dated as of 12000 by and between the CITY OF ST. <br /> ANTHONY, MINNESOTA, a public body corporate and politic (the "City'), and HWICREST <br /> DEVELOPMENT, a Minnesota limited partnership ("Redeveloper"). <br /> 1. Request for Planned Unit Development Approval. <br /> Redeveloper has asked the City to approve a Planned Unit Development Plan to redevelop <br /> certain property in the City of St.Anthony known and referred to as Apache Plaza and legally <br /> described as follows(the "Property"): <br /> Tots 6 and 7.Block 1, Silver Lake Center, and Lot 5,Block 1,Apache plaza, <br /> according to the recorded plats thereof, Ramsey County, Minnesota,together with <br /> easements for ingress and egress as contained in a Reciprocal Easement Agreement <br /> filed as Document No.2927183. <br /> 2. Planned Unit Development Plan Approval. <br /> The City hereby acknowledges and confirms that at a meeting of the City Council of the City on <br /> August 22, 2000 the City Council approved Redeveloper's Application for Preliminary Development <br /> Plan and Final Development Plan for the Property (together herein referred to as the"Plan') subject to <br /> Redeveloper's execution and delivery of this Agreement and Redeveloper's compliance with the terms <br /> and conditions of this Agreement. The City agrees to approve applications for building permits for the <br /> Property,provided that(i)the uses of the Property and plans for the improvements submitted by <br /> Redeveloper are consistent with the Plan as approved by the City Council, and(ii)all of the conditions <br /> of this Agreement that are required to have been satisfied at the time of the application for the permit <br /> have been satisfied. <br /> 3. Compliance with PUD Ordinance and Development Plan.. <br /> Redeveloper applied to the City for approval of the Plan under Section 1655 of the City Code <br /> pertaining to planned unit developments (the"PUD Ordinance"). Redeveloper hereby agrees that all <br /> improvements to the interior and exterior of the building on the Property (the"Building?), interior and <br /> exterior building equipment and systems, landscaping, drainage and ponding,traffic tiow,parking, <br /> loading docks, signage, lighting, and all other improvements to the Property ("Improvements"), and all <br /> • uses of the Property, shall comply with the PUD Ordinance and with all applicable provisions of the <br /> Plan, including but not limited to all applicable Exhibits attached to the Plan. <br />
