ANTHONY <br /> RESOLUTION 00-075 <br /> A RESOLUTION RELATING TO HILLCREST DEVELOPMENT <br /> PUD; APPROVING EXECUTION OF PUD AGREEMENT <br /> WITH HILLCREST DEVELOPMENT <br /> BE IT RESOLVED by the City Council (the "Council") of the City of St. Anthony, Minnesota <br /> (the "City"), as follows: <br /> 1. Redevelopment Plan and Redevelopment Project. This Council and the Housing and <br /> Redevelopment Authority of the City of St. Anthony, Minnesota have previously <br /> approved a redevelopment plan.and redevelopment project under Minnesota Statutes, <br /> Section 469.001 to 469.047, and a tax increment financing plan, under Minnesota <br /> Statutes, Section 469.174 to 469.179, designated s Redevelopment Plan for <br /> Redevelopment Project No. 3 - Ramsey County, Redevelopment Project No. 3 - <br /> Ramsey County (the "Redevelopment project") and Tax Increment Financing Plan for <br /> Tax Increment Financing District No. 5 - Ramsey County. <br /> 2. PUD Plan Approval. At a meeting of the Council on August 22, 2000 the Council <br /> • approved the Application of Hillcrest Development ("Redeveloper") for a Preliminary <br /> Development Plan and Final Development Plan for the Redevelopment project (together <br /> herein referred to as the "Plan") subject to Redeveloper's execution and delivery of a <br /> Planned Unit Development Agreement and Redeveloper's compliance with the terms <br /> and conditions of the Planned Unit Development Agreement. <br /> 3. PUD Agreement. The City Attorney has prepared a Planned Unit Development <br /> Agreement which the Redeveloper is prepared to sign and which the Council has <br /> reviewed (the "PUD Agreement"). <br /> 4. Council Approval of PUD Agreement. The form and terms of the Redevelopment <br /> Agreement are hereby approved, and the execution and delivery by the City of the PUD <br /> Agreement and execution and delivery of any related permits and documents by the <br /> City as provided in the PUD Agreement are hereby authorized. The Mayor and City <br /> Manager are hereby authorized and directed to execute and deliver the PUD Agreement <br /> on behalf of the City in substantially the form presented hereto with such changes and <br /> modifications as may be approved by the officers executing the PUD Agreement. The <br /> execution and delivery of the PUD Agreement by the Mayor and City Manager shall be <br /> conclusive evidence of the approval of any changes and modifications to the PUD <br /> Agreement by such officers. <br />
