56 <br /> • the HRA, (ii) timely make any deposit required in this Section 3.3, or(iii) or close on the transfer of the <br /> portion of the Redevelopment Property acquired by the HRA, and may otherwise be abandoned by the <br /> HRA upon the direction of the Redeveloper. The Redeveloper has the sole discretion to direct the <br /> settlement of any condemnation proceeding commenced pursuant to this Section 3.3 or to direct the <br /> appeal of any commissioners' award in a condemnation proceeding initiated hereunder. <br /> Upon acquisition of title to any portion of the Redevelopment Property by the HRA <br /> pursuant to this Section 3.3, and provided that the Redeveloper has satisfied the terms and conditions <br /> contained in this Agreement, including payment of all Acquisition Costs incurred by the HRA through <br /> the date of the transfer of title from the HRA to such Redevelopment Property to the Redeveloper, the <br /> HRA will quitclaim title to such Redevelopment Property to the Redeveloper on the applicable Closing <br /> date or such other date as the parties hereto may mutually agree upon in writing, and the Redeveloper <br /> shall accept such conveyance at that time. <br /> Unless otherwise mutually agreed by the HRA and the Redeveloper, the execution and <br /> delivery of all documents (including any conveyance documents from the Redeveloper to the HRA) and <br /> the payment'of any Acquisition Costs shall be made at the principal office of the HRA at 3301 Silver <br /> Lake Road in St. Anthony. <br /> All deeds to the Redevelopment Property shall be in recordable form and shall be <br /> • promptly recorded in the appropriate Ramsey County office at the Redeveloper's sole expense <br /> (including without limitation payment of all state deed tax and recording fees for the same). <br /> ARTICLE 4 <br /> Completion of Project <br /> Section 4.1 Undertaking of Project. <br /> (a) Subject to Unavoidable Delays, Redeveloper will complete the Project all in <br /> accordance with the terms of the PUD Agreement. <br /> (b) Redeveloper shall promptly begin the Project and.diligently prosecute the Project <br /> to completion in accordance with the requirements of the PUD Agreement. Redeveloper shall make <br /> reports, in such detail and at such times as may reasonably be requested by the HRA, as to the actual <br /> progress of Redeveloper with respect to the Project. <br /> (c) Redeveloper shall not interfere with, or construct any improvements over, any <br /> public street or utility easement without the prior written approval of the City. All connections to public <br /> utility lines and facilities shall be subject to approval of the City and any private utility company <br /> involved.
