the affidavit of a witness of such execution or by the •. <br /> certificate of- any notary public or other officer authorized by <br /> law to take .acknowledgments of deeds, certifying that the. , <br /> person signing it acknowledged to him the- execution thereof. <br /> The - amount of bonds held %by any person by- or for whom a consent . <br /> is given, and the distinguishing numbers of such .bonds, and the <br /> date of his holding the same,' shall be proved by the Bond <br /> Register. <br /> Section 6. Defeasance. When all of the bonds of any <br /> series payable from the Revenue Bond Account have been paid and <br /> discharged . as provided in this section all pledges,, covenants <br /> and other rights granted by this resolution shall cease. <br /> 6 . 01 . Payment. The City may pay and discharge all <br /> such bonds due on any date by depositing with the paying agent, <br /> or any successor paying agent, a sum sufficient for the payment <br /> thereof in full and, if. applicable, with interest accrued from <br /> the due date to the date of such deposit. <br /> 6.02 . Escrow. The City may pay and discharge all <br /> bonds of any series at any time by irrevocably depositing in <br /> escrow with the paying agent or any bank or financial <br /> institution authorized by law to act as escrow agent for the <br /> purpose of paying- all principal and interest due on such bonds • <br /> to their respective maturities or earlier designated redemption <br /> date, a sum of cash and/or securities as specified in Minnesota <br /> Statutes , Section 475 . 67, in .such aggregate face amount, <br /> bearing interest at such rates and- maturing or callable at the <br /> holder 's option .on such dates as shall be required to provide <br /> funds sufficient for this purpose. <br /> 6 . 03 . Moneys Held in Trust. Any moneys or securities <br /> which at any time shall be deposited by or on behalf of the , - <br /> City with the paying agent or other institution for the purpose <br /> of paying and discharging any bonds shall be held by such , <br /> paying agent or institution in trust for the respective owners <br /> of such Bonds" and are hereby irrevocably appropriated to such <br /> payment and discharge. <br /> Section 7. Registration,. Certification of <br /> Proceedings, Tax Covenant. <br /> 7 . 01 . Registration. The City Clerk is hereby <br /> authorized and directed to file a certified copy of this <br /> resolution with the County Auditors of Hennepin and Ramsey - <br /> Counties-; together with such other information as they shall <br /> require; and to- obtain from said County Auditors a certificate <br /> that the Bonds have been entered on their bond registers as <br /> required by law. <br /> -20- <br />
