Minnesota 55418 <br /> Re: Charitable Gambling <br /> Dear Mayor Sundland and Members of the Council.: , <br /> You have asked us to research several issues regarding <br /> • the control which the City would be able to exercise over <br /> charitable gambling within the City should the City decide to <br /> permit such gambling. The following questions in this regard <br /> were raised at a recent Council meeting: <br /> 1 . Can the City allow some organizations to conduct <br /> lawful gambling while prohibiting others? <br /> There. are at least two ways in which the City can <br /> exercise some control over which organizations are permitted to <br /> . conduct lawful gambling within •the City. First, Minn. Stat. <br /> § 349 . 213 , subd. 2 provides that the State Charitable Gambling <br /> Control Board ( "CGCB" ) must notify the City Council before <br /> issuing or renewing the license of any organization whose <br /> premises are• located within the City. If , within 30.. days of such <br /> notice, the City adopts a resolution disapproving the license, <br /> then the license may not be issued or renewed. Under Minn. Rules <br /> § 7860 .0040, subp. 6,' an organization must . obtain a separate <br /> .license for each premises where gambling is -to be conducted, with <br /> the exception of raffles . In addition, Minn. Stat . § 349 . 16, . <br /> subd. 4 authorizes the City to assess an investigation fee on <br /> organizations applying for licenses to conduct gambling within <br /> the City . These provisions appear to give - the City unlimited <br /> veto power over such organizations . Of course, the Constitution <br /> imposes some limits on the City ' s freedom to discriminate between <br /> similarly situated applicants . - Your actions must, at a .minimum, <br /> • be rationally related to a legitimate governmental purpose.
