Can the City: require that a certain percentage of <br /> the receipts from lawful gambling go directly to local charities? <br /> Again, this is at least arguably within the City ' s <br /> authority under Minn. Stat. § 349 . 213, subd. 1 to adopt "more <br /> stringent regulation" of lawful gambling. Minn. Stat. § 349 . 15 <br /> provides that no more than 50% of profits from bingo and no more <br /> than 40o. of profits from other forms of lawful gambling may be <br /> expended for "necessary expenses related to lawful gambling. " <br /> The remainder must be expended for "lawful purposes . " "Lawful <br /> purpose" is defined as one or more of the following: <br /> " (a) benefiting persons by enhancing their opportunity <br /> for religious or educational advancement, by relieving <br /> or protecting them from disease; suffering or distress , <br /> by contributing to their physical well-being, by <br /> assisting them in establishing themselves in life <br /> as worthy and useful citizens, or by increasing <br /> their comprehension 'of and devotion to the principles <br /> upon which this nation was founded; (b) initiating, <br /> performing, • or fostering worthy public works or <br /> enabling or furthering the erection or maintenance <br /> of public structures ; - (c ) lessening the burdens <br /> borne by government or voluntarily supporting, <br /> augmenting or supplementing services which government <br /> would normally render to the people; or (d) the <br /> improving, expanding,. maintaining or repairing <br /> real property owned or leased by an organization. <br /> ' Lawful purpose ' does not include the erection <br /> or acquisition of any real property, unless the <br /> board specifically authorizes the expenditures <br /> after finding that the property will be used <br /> exclusively for one or more of the purposes specified_ <br /> in this clause . " <br /> Minn . Stat. § 349 . 12 , subd. 11 . "Profit" is defined as gross <br /> receipts less "reasonable sums necessarily and actually expended <br /> for prizes and. taxes- imposed by this chapter . " Minn. Stat . <br /> § 349 . 12 , subd: 13 : The following expenses are allowed to be <br /> taken from gross -receipts under Minn.
