Fuchs is ,a request for vacation of five feet of <br /> the fifteen foot utility easement to construct an addition to his garage at 2416 <br /> 34th Avenue N.E. <br /> *I can see no reason not to grant the vacation of the easterly five feet of <br /> the easement. <br /> *The City can make the necessary repairs to the utility within the 25 feet <br /> remaining. <br /> *Mr. Fuchs. has agreed to pay the attorney's cost. <br /> *Mr. Fuchs has also stated that if a major failure with the utility lying <br /> within this easement occurs, he will not hold the City responsible. <br /> I would recommend approval of this request. <br /> :cjk3.29.88 <br />
