(a) Failure of Redeveloper to pay when due the <br /> • payments required hereunder within 10 days after notice from <br /> the HRA. <br /> (b) Failure of Redeveloper to construct or <br /> reconstruct the Minimum Improvements as required hereunder, <br /> after the 30-day notice referred to in Section 4 . 5(a) . <br /> (c) Failure -of Redeveloper to furnish the <br /> Construction Plans as required hereunder, after the 30-day <br /> notice referred to in Section 4 . 5 (a) . <br /> (d) Failure of Redeveloper to pay real estate taxes <br /> as required hereunder within 10 days after notice from the HRA. <br /> (e) Failure to replace the Letter of Credit as <br /> required under Section 10 . 10 . <br /> (f) Failure of Redeveloper to observe and perform any <br /> covenant, condition, obligation or agreement on its part to be <br /> observed or performed hereunder, within 30 days after written <br /> notice to Redeveloper specifying such failure and requesting <br /> that it be remedied (or within such other period as otherwise <br /> expressly provided in this Agreement) . <br /> (g) If Redeveloper or either of the Guarantors shall <br /> • admit in writing its inability to pay its debts generally as - <br /> they become due, or shall file a petition in bankruptcy, or <br /> shall make an assignment for the benefit of its creditors, or <br /> shall consent to the appointment of a receiver of itself or of <br /> .the whole or any substantial part of the Redevelopment Property. <br /> (h) If Redeveloper or either of the Guarantors shall <br /> file a petition or answer seeking reorganization or arrangement <br /> under the federal bankruptcy laws . <br /> (i) . If Redeveloper, or either of the Guarantors, on a <br /> petition in bankruptcy filed against it, be adjudicated a <br /> bankrupt, or a court of competent jurisdiction shall enter an <br /> order or decree appointing, without the consent of the <br /> Redeveloper or the Partner, a receiver of all or substantially <br /> all of its property, or approve a petition seeking <br /> reorganization or arrangement under the federal bankruptcy <br /> laws, and such adjudication, order or decree shall not be <br /> vacated or set aside or stayed within 60 days from the date of <br /> entry thereof . <br /> (j ) If Redeveloper is in default under any Mortgage <br /> and fails to cure any such default within - the time period <br /> provided for in the Mortgage. <br /> • -20- <br />
