FRIDLEY,MN 55432• (612)571-3450• FAX (612)571-1287 <br /> October 19, 1989 PW89-216 <br /> Larry Hamer <br /> City of St. Anthony <br /> 3301 Silver Lake Road <br /> St. Anthony, MN 55418 <br /> SUBJECT: Joint Powers Agreement <br /> Dear Mr. Hamer: <br /> The League of Minnesota Cities, which provides insurance for many <br /> of the cities in the metropolitan area, have reviewed the Joint <br /> Powers Agreement and Constitution and By-Laws of the Regional <br /> Mutual Aid Association (RMAA) . <br /> Their review raised some concerns regarding third party law suits <br /> and liability of the association based. upon the requirements to <br /> provide distribution and information to its members. <br /> I met with representatives from the League of Minnesota Cities, <br /> Peter Tritz and Conway G. Olson from the Risk Management Office to <br /> discuss this issue. In an attempt to resolve their concerns and <br /> to provide for improved insurance coverage, they have submitted a <br /> recommended change to the Constitution and By-Laws which should <br /> eliminate some of the liability issues. <br /> In addition, they propose' to submit changes to the .Joint Pokers <br /> Agreement which would eliminate the possibility of two (2.) cities <br /> fighting each other in a defense for an injury case. This proposal <br /> would specify that the requesting party would defend and indemnify <br /> the responding party for all liabilities arising out of the <br /> activity and require the Joint Powers Agreement to be modified and <br /> approved by the member cities. <br /> At the MnPWA Fall Conference General Membership Meeting scheduled <br /> for November 16, 1989, I propose to submit to the RMAA members the <br /> proposed change to the Constitution and By-Laws for consideration <br /> and approval. If the Joint Powers Agreement changes are available, <br /> I will present them to the members for consideration and submittal <br /> for formal adoption by the member cities. <br />
