City of Saint Anthony Housing Maintenance Ordinance <br /> Draft Number 5 -- September 2, 1992 <br /> Page Number 18 <br /> 1 The City Manager and delegated inspectors are hereby authorized to make <br /> 2 inspections reasonably necessary to the enforcement of this ordinance, but at least <br /> 3 annually. <br /> 4 <br /> 5 All police officers, sanitarians, or health officers of the City may inspect a multiple <br /> 6 dwelling when requested by the City Manager. <br /> 7 <br /> 8 All persons authorized to inspect shall have the authority to enter, at reasonable <br /> 9 times, any multiple dwelling licensed pursuant to this ordinance. <br /> 10 <br /> 11 Persons inspecting a multiple dwelling shall notify the licensee of all violations, if any, <br /> 12 by written notice. The notice shall direct compliance in not less than 15 days, unless <br /> 13 extended by the City Manager for good cause. <br /> 14 <br /> 15 REVOCATION OR SUSPENSION. <br /> 16 <br /> 17 Every license issued under this ordinance is subject to the right, which is hereby expressly <br /> 18 reserved, to suspend or revoke the same should the licensee or the licensee's agents, <br /> 19 employees, representatives or lessees directly or indirectly operate or maintain a multiple • <br /> 20 dwelling contrary to the provisions of state or federal law, this or any other ordinance of the <br /> 21 City; or any permit issued by the City. <br /> 22 <br /> 23 A license may be suspended or revoked by the Council after written notice to the licensee <br /> 24 specifying the violations. The notice shall also specify the date for a hearing before the <br /> 25 Council, which shall not be less than 10 days after the date of the notice. <br /> 26 <br /> 27 At the hearing, the licensee may present any evidence relevant to the violations specified in <br /> 28 the notice. <br /> 29 <br /> 30 After a hearing, the Council may suspend or revoke the license if deemed necessary to <br /> 31 protect'the public health, safety or welfare. <br /> 32 <br /> 33 SUMMARY ACTION. <br /> 34 <br /> 35 When the conduct of a licensee or the licensee's agent, representative, employee of lessee, <br /> 36 or the condition of the licensed multiple dwelling, constitutes a nuisance, fire or health <br /> 37 hazard, unsafe or dangerous condition, or other emergency, the City Manager may <br /> 38 summarily condemn or close off the multiple dwelling or a portion thereof. <br /> 39 <br /> 40' Any person aggrieved by a decision of the City Manager shall be entitled to appeal to the <br /> 41 Council, immediately, by filing a notice of appeal with the Manager. The Manager shall <br /> 42 schedule a date for hearing before the Council and notify the aggrieved person of the date. <br />
