• MEMORANDUM <br /> DATE: June 20, 1996 <br /> TO: Michael Mornson, City Manager <br /> FROM: Kim Moore-Sykes, Management Assistant <br /> ITEM: City Property Conveyed to Roger Bona <br /> 1. I reviewed the 1993 agreement the City entered into with Roger Bona regarding the <br /> turnback of City property as the result of vacation of 27th and Coolidge. The <br /> agreement states that the City will convey the property to Bona given certain <br /> conditions: <br /> a. Once Parcel A (see attached) is conveyed to Bona, the City reserved a <br /> landscaping easement of 10 feet wide along the Northwest length of Parcel <br /> A. There is no date given or length of time expressed whereby the City's <br /> right to the Landscape Easement expires. <br /> • b. Art icle 5(b) of the agreement states that Bona will maintain "in a neat and <br /> attractive condition" all grass, bushes, trees, and other landscaping located in <br /> the Landscape Easement of Parcel A. If he fails to maintain the landscaping <br /> on the easement, he will be responsible for replacing it. <br /> C. Bona must maintain fencing or landscaping on the WEST portion of his <br /> property for the protection of the residents on that side. <br /> So it seems while Bona was conveyed Parcel A, the City retained a landscaping easement. <br /> He has maintained it and apparently any improvements done to the landscaping there is <br /> the City's responsibility. <br /> • <br />
