8. Improvements. The Developer shall install and pay for all improvements on the <br /> Property. The improvements shall be installed in accordance with the City Zoning Ordinance • <br /> and Building Code; City standard specifications for utilities and street construction; and any <br /> other ordinances or laws including erosion and drainage. The Developer shall submit plans and <br /> specifications, which have been prepared by a competent registered professional architect, to the <br /> City for approval by the City Engineer and City Building Inspector. The Developer shall obtain <br /> any other necessary permits. The Developer shall instruct its architect and engineer to provide <br /> adequate field inspection personnel to assure an acceptable level of quality control to the extent <br /> that the Developer's architect will be able to certify that the construction work meets the <br /> approved City standards and ordinances as a condition of City acceptance. The Developer shall <br /> provide on-site project management. The Developer's architect is responsible for design changes <br /> and contract administration between the Developer and the Developer's contractor. The <br /> Developer or his architect shall schedule a pre-construction meeting at a mutually agreed time at <br /> the City with all parties concerned, including the City staff, to review the program for the <br /> construction work. Within 30 days after the completion of the improvements and before the <br /> security is released, the Developer shall supply the City with a complete set of reproducible "as <br /> constructed" plans, an electronic file of the "as constructed" plans in a auto CAD.DWG file or a <br /> DXF file, all prepared in accordance with City Ordinances and standards. <br /> 9. Time of Performance. The Developer shall install all required site improvements, <br /> landscaping and lighting prior to September 1, 2000 as agreed to by Developer and the City as a <br /> part of the revised St. Anthony Shopping Center Design Plan and Landscaping Plan. The <br /> Developer may, however, request an extension of time from the City Manager. If an extension is • <br /> granted, it shall be conditioned upon updating the security posted by the Developer to reflect cost <br /> increases and the extended completion date. <br /> 10. License. The Developer hereby grants the City, its agents, employees, officers and <br /> contractors a license to enter the site to perform all work and inspections deemed appropriate by <br /> the City in conjunction with site improvements. <br /> 11. Erosion Control. Prior to initiating site grading, the erosion control shall be , <br /> implemented by the Developer and inspected and approved by the City. <br /> 12. Clean Up. The Developer shall clean'dirt and debris from streets that has resulted from <br /> construction work by the Developer, contractor, subcontractors, its agents or assigns. Prior to <br /> any construction, the Developer shall identify-in writing a responsible party and schedule for <br /> erosion control, street cleaning, and street sweeping. <br /> 13. Ownership of Improvements. Upon completion of the work and construction required <br /> by this Agreement, the improvements lying within public easements or public right-of-way shall <br /> become City property without further notice or action. <br /> 14.
