This subdivision does not include temporary or seasonal <br /> positions or unionized employees who have a sick pool that is already established. <br /> Section 4. Section 300.10 is hereby deleted in its entirety. <br /> Section 5. Subdivisions 1, 2 and 5 of Section 300.19 are amended to read as follows: <br /> 300.19 Discipline. <br /> Subd. 1. In General: City employees shall be subject to disciplinary action for failing to <br /> fulfill their duties and responsibilities, including observance of work rules adopted by <br /> the City Council. it is the policy of the City to administer disciplinary penalties without <br /> discrimination. Every disciplinary action shall be for just cause and a permanent full <br /> time employee may use the grievance procedure with respect to any disciplinary action <br /> which he or she believes is either unjust or disproportionate to the offense committed. <br /> Subd. 2. Disciplinary Actions Steps: Except for severe infractions, disciplinary action <br /> against any permanent full time employee shall be progressive and follow the steps <br /> listed below in numerical order: <br /> Subd. 5. Hearing: In any case of suspension, dismissal, or demotion, a permanent full <br /> time employee shall be granted a hearing before the City Manager if the employee <br /> submits a written request for such a hearing to the City Manager within five working <br /> days of notification of the action taken. The hearing shall be held within ten working <br /> days from the date the request is filed unless the City and the employee agree on an <br /> earlier,or later date. If the disciplinary action involves the removal of a veteran, the <br /> hearing shall be held in accordance with Minnesota Statutes. <br /> Section 5. Effective Date.
