87
ANALYSIS --
• The Nativity Church was constructed in 1958 and at approximately the same time, the sign was
installed. Since the City's Ordinance was not codified until 1976, both the Church and their
identifying sign are "grandfathered in" with regard to the setback requirements.of the
Ordinance. Glenn Seefeldt,Pastor of Nativity Lutheran Church, submitted a Petition for
Variance to the front yard setback requirement to allow the Church's, sign to continue
to exist in-its present location.
The State Statute and the City Ordinances require that the following conditions must be satisfied.
for approval of this request: that the proposed variance would relieve an undue hardship;that
the proposed variance would be used to correct an extraordinary circumstance which is not
applicable to another property in the vicinity or zoning district; and that the hardship was caused
by the City Ordinance and granting the variance would not alter the essential character of the
locality. The Church's sign has continued to exist in.its present location since the Church was
constructed in the late 1950's. In its present location,it has not caused nor.does it cause any
public safety issues for those traversing Silver Lake Road.
i
•
