87 <br /> ANALYSIS -- <br /> • The Nativity Church was constructed in 1958 and at approximately the same time,the sign was <br /> installed. Since the City's Ordinance was not codified until 1976, both the Church and their <br /> identifying sign are "grandfathered in" with regard to the setback requirements.of the <br /> Ordinance. Glenn Seefeldt,Pastor of Nativity Lutheran Church, submitted a Petition for <br /> Variance to the front yard setback requirement to allow the Church's, sign to continue <br /> to exist in-its present location. <br /> The State Statute and the City Ordinances require that the following conditions must be satisfied. <br /> for approval of this request: that the proposed variance would relieve an undue hardship;that <br /> the proposed variance would be used to correct an extraordinary circumstance which is not <br /> applicable to another property in the vicinity or zoning district; and that the hardship was caused <br /> by the City Ordinance and granting the variance would not alter the essential character of the <br /> locality. The Church's sign has continued to exist in.its present location since the Church was <br /> constructed in the late 1950's. In its present location,it has not caused nor.does it cause any <br /> public safety issues for those traversing Silver Lake Road. <br /> i <br /> • <br />
