(a)clause 2 that states that"more than 50%of the buildings(not including out <br /> buildings)must be Mound to be structurally substandard to a degree requiring substantial <br /> renovation or clearance"The proposed area includes the above described property which <br /> exhibits over 50% of the buildings(2 out of 2 buildings) with deficiencies warranting <br /> substantial renovation or clearance and appears to qualify the proposed area eligible for TIF <br /> district interpretation under the Redevelopment Statute. <br /> Also the statute stipulates a building is not structurally substandard if it is in compliance with <br /> the building code applicable to new buildings or could be modified to satisfy the building code <br /> at a cost of less than 15% of the replacement cost of constructing a new structure of similar <br /> square footage and type of building on the same site. The city may find that a building is not <br /> disqualified as structurally substandard under the preceding sentence on the basis of reasonably <br /> available evidence, sucb as size ,type, and age of the building,the average cost of plumbing and <br /> electrical,or structural repairs or other similar reliable evidence(public construction permit <br /> activity). If the evidence supports a reasonable conclusion that the building is not disqualified as <br /> structurally substandard,the city may NOT make such determination without an interior <br /> inspection of the property.
