John Ohl <br /> SUBJECT: Curfew Ordinance <br /> On December 20, 1994, the Hennepin County Board of Commissioners adopted a <br /> Juvenile Curfew Ordinance. This particular curfew ordinance was amended on June 27, <br /> 1995, and has been static ever since. <br /> The Hennepin County Ordinance essentially indicated that: <br /> i <br /> • Juveniles under 12 YOA had to be home weekdays by 9:00 p.m., and Friday and <br /> Saturday, home by 10:00 p.m. <br /> i . <br /> • Juveniles ages 12 — 14 had to be home 10:00 p.m: on weekdays, and home by 11:00 <br /> • p.m..on Friday and Saturday. <br /> • Juveniles ages 15 — 17 had to be home by 11:00 p.m. on weekdays, and home by <br /> midnight on Friday and Saturday. <br /> The Hennepin County Ordinance was different from our curfew ordinance (1105.01 & <br /> .02) in essentially two ways. The St. Anthony Ordinance governed persons under 16 <br /> YOA, and set the curfew at 10:00 p.m. on any day of the week. Our ordinance did not <br /> restrict 16 and 17 year olds. <br /> Minnesota State Statute 145A.05, Subd. 7A allows for a County Board to adopt a county- <br /> wide curfew for unmarried persons under the age of 18. <br /> Minnesota State Statute 145A.05, Subd. 9 allows governing bodies of cities or towns to <br /> adopt ordinances related to public health, however, these ordinances must not conflict <br /> with or be less restrictive than ordinances adopted by the County Board within who's <br /> jurisdiction the city or town is located. This statute gives the County Board the right to <br /> supercede our curfew ordinance. <br /> Our department has been enforcing the Hennepin County Curfew Ordinance, however, <br /> our city curfew ordinance was never taken off the books. It has now been suggested that <br /> we formally adopt the Hennepin County Curfew Ordinance. The'Police Department <br /> • would be in favor of adopting the Hennepin County Ordinance, as we have already been <br /> enforcing the ordinance since 1994. <br />
