14 ARTICLE 1 ® Definitions Section 1.1. Definitions. In this Agreement, unless a different meaning clearly appears from the context: "Act"means Minnesota Statutes, Sections 469.001 through 469.047. "Agreement" means this Agreement, as the same may be from time to time modified, amended or supplemented. "Certificate of Completion" means a certification in the form attached as Exhibit A, to be provided to Redeveloper pursuant to this Agreement. "City" means the City of St. Anthony, a Minnesota municipal corporation. "Construction Plans" means the plans, specifications, drawings and related documents for the construction work to be performed by Redeveloper on the Redevelopment Property as a part of the Project, which (a) shall be at least as detailed as the plans, specifications, drawings and related documents which are submitted to the building inspector of the City and (b) shall include at least the following: (1) site plan;(2) foundation plan; (3) basement plans; (4) floor plan for each floor; (5) elevations on all sides; (6).landscape plan; (7) grading plan; and (8) utility plan. "Declaration" means the Declaration of Restrictive Covenants set forth in Exhibit B hereto. "Event of Default" means as set forth in Section 7.1 hereof. "HRA" means the Housing and Redevelopment Authority of St. Anthony, Minnesota, a public body corporate and politic under the laws of the State of Minnesota. "Plans" means Redeveloper's plans for the Project prepared by , dated as submitted to the City and the HRA, with any subsequent amendments approved by the HRA. "Project" means the construction of a Walgreens retail store and related common areas and site improvements, all as further described in Schedule B attached to this Agreement. "Project Area" means the area designated for redevelopment by the HRA pursuant to the Redevelopment Plan and the Act. "Redeveloper" means Meridian St. Anthony, L.L.C., a Minnesota limited liability company. • -2
