Morrison City Manager City of St. Anthony 3301 Silver Lake Road St. Anthony, MN 55418 • Re: Anthony Lane Street Vacation Dear Mike: In accordance with our discussions, I have prepared and enclose the documents to vacate a portion of Anthony Lane pursuant to the petition of Accurate Wire Solutions, Inc. Street vacations are governed by Minnesota Statutes § 412.851, which gives the Council the authority to vacate a street by resolution on its own motion or on petition of a majority of the owners of land abutting the street. A petition has been submitted by Accurate Wire Solutions, Inc. If any of the street abutting the property of other owners is to be vacated, you may wish to have them sign a petition. When a petition has been submitted, the resolution may be adopted by a majority vote. For future reference, if there is no petition, the resolution may be adopted only by a vote of four-fifths of all members of the Council. It is necessary to hold a public hearing preceded by two weeks published and posted notice. The statute also requires that notice of hearing be mailed to each property owner affected by the proposed vacation at least 10 days before the hearing. As we discussed, we should have WSB prepare a proper legal description of the area to be vacated and that can then be attached as Exhibit A where indicated in the enclosed documents. This needs to be done before the notice is published.
