55 <br /> (9) Any manager,proprietor,or agent in charge of the business has committed <br /> fraud,misrepresentation or made false statements in the application and <br /> investigation for the applicant's business; or <br /> (10) Business practices, or conduct, deemed by the City to be contrary to the best <br /> interests,or safety,of the public; or <br /> (11) Any manager,proprietor,or agent in charge of the business has violated <br /> within the preceding five(5) years, of any law relating to theft, damage or <br /> trespass to property, sale of a controlled substance,or operation of a <br /> business. <br /> 565.12. Bond Required. <br /> At the time of filing an application for a license, the applicant shall file a bond in the <br /> amount of Five Thousand Dollars ($5,000.00)with the City. The bond, with a duly licensed <br /> surety company as surety thereon, must be approved as to form by the City Attorney. The bond <br /> must be conditioned that the licensee shall observe all ordinances of the City and all laws in <br /> regulation to the business of secondhand dealers, and that the licensee will account for and <br /> deliver to any person legally entitled thereto any articles which may have come into the <br /> possession of the licensee as a secondhand dealer, or in lieu thereof such licensee shall pay the <br /> person or-persons the reasonable value thereof. The bond shall contain a provision that it may <br /> not be cancelled without thirty(30) days advance written notice to the City. <br /> 565.13. Records Required. <br /> A. Exempt Transactions. The following items,when received by a dealer, are exempt <br /> from recording and reporting requirements in this Section,regardless of the purchase price paid by <br /> the dealer, asking price if consigned or brokered, or value attributed to it if accepted in trade: <br /> (1) The receipt of new or used merchandise from a merchant,manufacturer or <br /> wholesaler having an established permanent place of business, and the retail <br /> sale of said merchandise,provided the secondhand dealer must maintain a <br /> record of all such transactions which describes each item,and must identify <br /> such items in a manner which relates them to that transaction record. Any <br /> identification code used by the dealer must be provided to the Chief of <br /> Police, or the chiefs designee upon request. <br /> (2) The sale or receipt of secondhand household kitchen and laundry appliances. <br /> (3) The sale or receipt of secondhand furniture, excluding audio, video and other <br /> electronic devices. <br /> (4) The sale or receipt of secondhand cookware, glassware and eating utensils <br /> that do not contain precious metals. <br /> 12 <br />
