The Applicant commits to finishes and specifications consistent with the Preferred <br /> Plan Baseline or Fallback Plan Baseline. <br /> iii. Performance Standards—Preferred Plan <br /> a. Internal Improvements. With respect to internal improvements, the <br /> Applicant discusses and negotiates with each individual tenant a <br /> list of improvements that may be made within a certain parameter, <br /> in addition to the allowance for tenant finishes. The list of basic <br /> specifications includes parameters for the floor, ceiling, lighting, <br /> HVAC, electric, exterior walls, sprinkler, restrooms, and other <br /> miscellaneous specifications ("Specifications"). An example of <br /> the list of interior Specifications is discussed with each individual <br /> tenant. An example of the list of interior Specifications that will <br /> be used for the subject Property under the Preferred Plan is <br /> attached hereto as Exhibit C. The Specifications do not include <br /> tenant finishes, as tenant allowance for said finishes is negotiated <br /> between the Applicant and the tenant. <br /> The Specifications include specifications, which support the type <br /> of uses the tenant is pursuing in the Preferred Plan. <br /> In other projects, like the Preferred Plan Baseline, the Applicant <br /> provides the tenant some artistic discretion with respect to the <br /> tenant finishes. In many of the Applicant's projects, with the <br /> tenant finishes the tenant desires to make a statement with respect <br /> to the tenant's business. The Applicant's in-house architectural <br /> staff work with each tenant's retained third-party architect to <br /> design their space, including the tenant finishes. <br /> b. Landscaping. The Site Plan attached hereto as Exhibit B identifies <br /> ,the landscaping for the entire property, including the New Market <br /> Property and Lot 6, Block 1, Apache Plaza ("Taco Bell Property"). <br /> A sampling of plantings is identified on the Site Plan. The types of <br /> plantings will comply with the City's Zoning Ordinance, Section <br /> 1650.08 (subd. 3). The minimum diameter of non-ornamental <br /> trees shall be at least 2V2 inches. All ornamental trees shall be at <br /> least 1'/z inches in diameter. The size of shrubs and other plantings <br /> shall be of an agreed upon size. <br /> The Applicant's ability to landscape the Taco Bell Property will <br /> depend on the terms of the existing Taco Bell lease. <br /> The installation of the landscaping will be phased. The actual <br /> phasing schedule will depend on the location of the initial tenants. <br /> Depending on the size of the initial tenants, it is likely that the <br /> 6 <br />
