1 <br /> 6 <br /> (F) Liquor stores. <br /> (G) Multi-family attached residential dwellings, with a minimum net density of eight (8) units <br /> per acre, if purely residential units and combined living and working units are mixed on a <br /> given floor. <br /> (H) Outdoor seating within the public right-of-way or public open space for a permitted or <br /> conditional use, provided that: <br /> 1. A sidewalk area at least six-feet (6') wide is maintained free of seating in the area. <br /> 2. An outdoor seating plan is prepared and approved by the City Council on the <br /> recommendation of the Planning Commission, Community Development Director, Fire <br /> Marshall, and Public Works Director, and on finding that the plan will not compromise <br /> public health, safety, or welfare. The plan may also include seasonal temporary <br /> landscaping and features such as planter boxes, hanging baskets, low partitions, roped off <br /> areas, and other approved elements. <br /> (1) Projecting signs over the public right-of-way or public open space for a permitted or <br /> conditional use, provided that: <br /> 1. The sign is approved by the City Council on the recommendation of the City staff, <br /> and on finding that the sign placement will not compromise public health, safety, or <br /> welfare. <br /> 2. The sign shall meet all other provisions for signs under this section. <br /> (J) Theaters, convention halls. <br /> (K) Expansion of non-conforming uses. Non-conforming buildings and sites can be <br /> maintained. Non-conforming buildings and sites that are damaged up to 50% of their <br /> assessed value may be re-built. Non-conforming buildings and sites may be expanded up <br /> to 10% (ten percent) of their floor area or assessed value, provided that this expansion is <br /> consistent with the zoning that existed prior to the effective date of this ordinance. <br /> Expansion of non-conforming uses by more than 10% (ten percent) of their floor area or <br /> assessed value is not allowed, unless such expansion brings the entire site into <br /> compliance with the standards and design guidelines contained in this chapter. <br /> 10-22B-5: TEMPORARY SEASONAL USES: Within any HOC Heart of the City District, <br /> the following uses may be allowed by Temporary Seasonal Permit, as regulated by <br /> Section 10-19-2-1 of the City Code: <br /> Farmers markets. <br /> Street vendors. <br />
