• CHAPTER 16. ZONING AND LAND USE <br /> SECTION 1680—WIRELESS TELECOMMUNICATION TOWERS AND FACILITIES <br /> 1680.01. Council Findinigs. The Communications Act of 1934 as amended by the <br /> Telecommunication Act of 1996 grants the Federal Communications Commission jurisdiction <br /> over many aspects of telecommunications services. The City's regulation of Towers and WTFs <br /> in the City will not have the effect of prohibiting any person from providing wireless <br /> telecommunications services in violation of the Act. <br /> 1680.02. Purpose. The general purpose of this Section is to regulate the placement, <br /> construction, and modification of Towers and WTFs in order to protect the health, safety, and <br /> welfare of the public, while at the same time encouraging the development of the competitive <br /> wireless telecommunications marketplace in the City. The specific purposes of this Section are: <br /> (a) To allow the location of telecommunication Towers and WTFs in the City; <br /> (b) To protect residential areas from potential adverse impact of Towers and WTFs; <br /> (c) To minimize adverse visual impact of Towers and WTFs through careful design, <br /> siting, landscaping, and innovative camouflaging techniques; <br /> (d) To promote and encourage shared collocation of Towers and Antenna support <br /> ® structures as a primary option rather than construction of additional-single-use <br /> Towers; <br /> (e) To promote and encourage utilization of technological designs that will either <br /> eliminate or reduce the need for erection of new Tower structures to support <br /> WTFs; <br /> (f) To avoid potential damage to property caused by Towers and WTFs by ensuring <br /> such structures are soundly and carefully designed, constructed,modified, <br /> maintained, and removed when no longer used or are determined to be <br /> structurally unsound; <br /> (g) To ensure that Towers and WTFs are compatible with surrounding land uses; <br /> (h) To overcome the potential adverse impacts that poorly or unregulated Towers and <br /> WTFs could have on the public health, safety and welfare; and <br /> (i) Enhance the ability of the providers of telecommunications services to provide <br /> such services to the community quickly, effectively, and efficiently. <br /> • <br />
