Gilligan <br /> Jay R.Lindgren <br /> DATE: November 3, 2004 <br /> RE: Vacation of Portion of Apache Lane <br /> At its meeting on November 9t" the City Council will be holding a public hearing on the <br /> vacation of a portion of Apache Lane. As part of the for sale and rental housing development <br /> occurring in connection with the redevelopment of Apache Plaza, a portion will <br /> no longer be required for public access under the re-platted property. The Redevelopment <br /> Agreement, dated December 19, 2003, provides that the City will consider the Developer's <br /> application, in accordance with state law and City ordinances, in a time frame consistent with <br /> development of the first housing phase. <br /> We have prepared a resolution vacating a portion of the public right-of-way and <br /> recommend that the City Council adopt this resolution. <br /> DORSEY&WHITNEY LLP, <br /> 4826-2534-9888\1 11/3/2004 1:48 PM <br />
