t
i
-3-
• 1 There was no one present to speak .either for or against. the proposal,
and ,the Chairman closed the hearing at 8:02 P.M. , for the Commission-
consideration and action.
-
Motion,.by .Commissioner Bjorklund and seconded by Commissioner Jones- to.
recommend the Council grant a one foot sideyard setback variance which
would allow Mike Pribula - to construct the single family dwelling he
proposes on the vacant lot at 3231 Roosevelt Street N.E, , finding that:

1. The proponent had developed a proposal which would conform to the
wishes of his neighbor to the south related to the placement of
his garage.

2 . There was no other opposition from adjoining property owners.

3. Several lots and homes of the same size have been developed on that
street.

4. The unique characteristics - of this lot with the extended shape and
no street address would appear to constitute a hardship for the
applicant to . construct his home according to the Ordinance requirements ., ll

Motion carried unanimously.

At 8 :07 P.M. , Chairman Zawislak opened the hearing to consider a petition.
from Edwin and Alyce Brown for a variance to the City Zoning Ordinance -
requirements which would allow them to reconstruct. their home at. 2702
33rd Avenue N.E which was severely damaged in the April tornado, with
an entryway which would be two feet closer to Belden Drive than its
existing distance of 14 . 2 feet. He read the notice which had been
Published June 6th ,-and mailed to all adjoining property owners of
record within 200 feet of the subject property. No one present reported
failure to receive that notice or objected to its content and the
Manager reported receiving no objections to the request.

Gary Brown, 1317 Hillside Circle, Chaska, -MN, who had accompanied his
parents to the meeting, presented their request, saying they wanted to
replace the old entryway with another which would be two feet longer
and which would not be' so steep. The Manager confirmed that this would
require a two foot variance from the setbacks established when the home
was built long before Belden Drive was constructed. In his June - 15th
memorandum, ' Mr. Childs - had recommended the variance be approved .per-
ceiving that the existing corner lot which is only 42 . 2 feet wide could
not accommodate a standard size house, anyway, and said there are
several other substandard lots and homes- in the same block which were
also grandfathered. in with the City Zoning Ordinance.
,
The applicants ' son assured Commissioner Jones that the existing driveway
.ended 'at the front door and that there would be no objections to having
it removed if 'there was a concern that it might be used to drive around .
the house.. The new garage fronts on Belden, he added. .. .
•53 Commissioner. Jones indicated he perceives the reconstructed- home- would
be a real asset to the neighborhood and he believes this to be just
another- instance of where the extra setback size. required for. corner
lots is not necessary.
