,f . <br /> EVERGREEN DEVELOPMENT CORPORATION <br /> 1920 Dain Tower <br /> Minneapolis, MN 55402 <br /> (612) 339 -9341 <br /> February 10, 1989 <br /> Mr. David Childs <br /> City Manager <br /> St. Anthony Village Hall <br /> 3301 Silver Lake Road <br /> St. Anthony, Minnesota 55418 <br /> Re: Evergreen Townhome Development in St. Anthony <br /> Dear Dave: <br /> I called you today, but you were out so I am,,,sending you this letter <br /> with two enclosures from Soo Line Railroad Company. <br /> As I indicated to you earlier this week, the Real Estate Department <br /> of the Soo Line had indicated that an easement would be required <br /> of 20' x 5501 . The cost of this easement they estimated at <br /> $16 ,500. 00,. Four days later I received another letter from -the Soo <br /> Line indicating that the Engineering Department had turned down the <br /> Real Estate Department' s request to place fill on the right-of-way. <br /> • This decision is a major stumbling block to the project. The soil <br /> correction sum of $230 ,000 was predicated on the fact that a part of <br /> the fill would be placed on this right-of-way. If we cannot _:lace <br /> the fill on the right-of-way, then the soil correction costs will <br /> increase substantially. Further, the project is in jeopardy because <br /> it will force us to do a retaining wall of approximately 550' in <br /> length and also put up a fence along side of it. <br /> At this time, I am wondering if there is anything that you or the <br /> City Council might do to intervene in this situation. Since Dennis <br /> Cavanaugh, President of the Soo Line, is a resident of St. Anthony, <br /> I am wondering if someone from your office or the Council might make <br /> a direct contact with him. He certainly has the authority to over- <br /> ride the Engineering Department if he desires to do so. <br /> I will give you a call the first of the week to discuss this matter <br /> further. All other facets of the project are going along nicely, but <br /> this decision by the Soo Line is a major setback. Please give this <br /> matter serious consideration and advise me if you have any suggestions <br /> about how to resolve it. <br /> Best wishes. <br /> Since y, <br /> V n S.
