CITY OF ST. ANTHONY <br /> RESOLUTION 93-041 <br /> A RESOLUTION RELATING TO A VARIANCE FROM THE STATE <br /> OF MINNESOTA FOR ROAD REHABILITATION ON <br /> 37TH AVENUE N.E. BETWEEN SILVER LAKE <br /> ROAD AND STINSON BOULEVARD <br /> WHEREAS, with the use of Minnesota State Aid funds, the City of St. Anthony desires <br /> pavement rehabilitation for 37th Avenue N.E. between Silver Lake Road and <br /> Stinson Boulevard; and <br /> WHEREAS, the Minnesota Department of Transportation granted a width variance to the <br /> City of St. Anthony for this rehabilitation conditional upon the City of St. <br /> Anthony's agreement to indemnify, save, and hold harmless the State of <br /> Minnesota and its agents and employees of and from any and all claims, <br /> demands, actions, or causes of action arising out of or by reason of allowing a <br /> street width of 42 feet face to face of curb, in lieu of the required 44 foot <br /> minimum street width on the above referenced construction project and further <br /> agrees to defend at the City's sole cost and expense any action or proceeding <br /> commenced for the purpose of asserting any claim of whatsoever character <br /> arising as a result of the granting of this variance. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Anthony <br /> hereby agrees to the conditions as set forth in the above paragraph. <br /> Adopted this day of 1993. <br /> Mayor <br /> ATTEST: <br /> City Clerk <br /> Reviewed for administration: <br /> City Manager <br />
