WRS: 5/4/94 <br /> • LEASE <br /> This Lease is entered into as of November 1, 1993, by and between the CITY OF ST. <br /> ANTHONY, a municipal corporation under the laws of the State of Minnesota <br /> ("Landlord") and ST. ANTHONY/NEW BRIGHTON SCHOOL DISTRICT NO. 282, a <br /> Minnesota public school district ("Tenant"). <br /> Landlord, in consideration of the rents and covenants herein, does hereby demise, <br /> lease and let unto the Tenant, and the Tenant does hereby hire and take from the <br /> Landlord the following described premises located in the County of Hennepin and <br /> the State of Minnesota: <br /> That portion of the building (the "Building") located at 3301 Silver <br /> Lake Road and legally described on Exhibit 2 attached hereto and made <br /> a part hereof (the "Property"), which leased portion of the Building is <br /> shown crosshatched on Exhibit 1 attached hereto and made a part of <br /> (the "leased premises"). <br /> TO HAVE AND TO HOLD THE PREMISES, without any liability or obligation on <br /> the part of Landlord of making any alterations, improvements or repairs of any kind <br /> • on or about the leased premises except as provided herein, for the term of twelve <br /> (12) months commencing November 1, 1993, unless terminated at an earlier date as <br /> hereinafter provided. <br /> ARTICLE 1. RENT. <br /> Tenant will pay to Landlord at 3301 Silver Lake Road, St. Anthony, <br /> Minnesota 55418, or at such other address as may be designated by Landlord, <br /> without prior demand and without any deduction or set-off, annual rent in <br /> the amount of $40,000.00, payable in monthly installments of $3,333.33 each. <br /> ARTICLE 2. TERM. <br /> The term of this lease shall be twelve (12) months commencing on <br /> November 1, 1993 and terminating on October 31, 1994 unless terminated at <br /> an earlier date as hereinafter provided. <br /> ARTICLE 3. UTILITIES AND SERVICES. <br /> Landlord agrees to furnish heat, water, sewer service, and electricity in <br /> reasonable amounts, and snow plowing, but Landlord shall not be liable for <br /> any loss or damage caused by or resulting_from any variation, interruption or <br /> • failure of such services due to any cause; and no temporary interruption or <br />
