48 <br /> MEMORANDUM <br /> TO: Michael Morrison, City Manager <br /> FROM: Jerry Gilligan <br /> DATE: September 10,'2001 <br /> RE: Procedure for Holding Special Election <br /> Minnesota Statutes, Section 205.10, provides that special elections may be held <br /> by a city in a question on which the voters are authorized by law to pass judgments. Examples of <br /> this would be the question of whether a city shall issue general obligation bonds where the <br /> issuance of the bonds must be approved by the voters and the question of whether a city shall <br /> issue on-sale liquor licenses. <br /> A special election may be ordered by the City Council on its own motion or upon <br /> a petition signed by a number of voters equal to 20% of the votes cast at the last City general <br /> election. <br /> Special elections may be held in conjunction with the City general election or <br /> may be held on any other date selected by the City Council, other than a date within 40 days after <br /> the state general election. <br /> Special elections are conducted and the returns made in the same manner as the <br /> City's general election. Minnesota Statutes, Section 205.16 sets forth the requirements for the <br /> publication and positions of the notice of election and sample ballots and provides that at least 49 <br /> days prior to the election the clerk is to give written notice to the county auditor of the date of the <br /> election and the title and language for each ballot question to be voted on at the election. <br /> For your reference I have attached copies of Minnesota Statutes, Section 205.10 <br /> and 205.16. <br /> JPG:pmh <br /> DORSEY & WHITNEY LLP <br />
