STAFF REPORT <br /> DATE: April 16, 1992 <br /> TO: Planning Commission Members <br /> FROM: , David Mark Urbia, Management Assistant <br /> ITEM: APPLICATION FOR CONDITIONAL USE PERMIT <br /> ----------------------------------------------------------------------------------------------------------------------- <br /> The following report is regarding a request from Adel Alwan for a conditional use permit <br /> to allow for more than three amusement devices at Sheik's Garden Restaurant, Inc.; 3800 <br /> Apache Plaza. <br /> The conditional use permit is necessary as Mr. Alwan proposes to have 23 amusement <br /> devices. According to the Zoning Ordinance, Appendix I, Section 9, Subdivision 3(14), <br /> an establishment is permitted to have more than three amusement devices (as defined <br /> in Section 510:05) only by conditional use permit. Mr. Alwan was before the Planning <br /> Commission in February to request a conditional use permit to allow up to 30 amusement <br /> devices. The Planning Commission approved the request unanimously under certain <br /> conditions. The City Council, at its March 10th meeting, did not approve the request by <br /> a 3 to 2 vote. <br /> Mr. Alwan's proposed plan (see attached drawing) would allow him to generate additional <br /> revenue in the older, rear portion of the restaurant. The front portion of the restaurant <br /> has been renovated. Mr. Alwan proposes rules that he believes will create a family <br /> atmosphere. In addition, Mr. Alwan will have-8 amusement devices solely for children. <br /> The remaining 15 amusement devices will be video devices for both children and <br /> adults.The three conditions are satisfied for this conditional use permit, if the owner <br /> carries out the intent stated in answering the -conditions. The Planning Commission <br /> should consider adding the following conditions in conjunction with recommending <br /> approval of the conditional use permit: <br /> (1) The arcade shall prohibit tobacco, alcohol, and drugs on the premises. <br /> (2) The arcade shall prohibit individuals under the influence of tobacco, alcohol, <br /> and/or drugs. <br /> (3) Proper supervision should be available at all times to ensure appropriate <br /> conduct and behavior. <br /> (4) The access from kitchen to dining area shall be segregated to ensure <br /> safety. <br />
