9) Management and Sales Office: In any Performance Residential, <br /> Multi-Family Residential, or Manufactured Housing development one <br /> dwelling unit may be devoted to use as an office for management of <br /> the development or as a headquarters for sales of other dwelling <br /> units in the development. One freestanding sign not to exceed six <br /> p ermitted for identification <br /> shall be <br /> (6) square feet in size <br /> purposes. Off-street parking equal to that required for office <br /> uses shall be provided. <br /> 62.280 SPECIAL RESIDENTIAL SETBACK PROVISIONS: This section identifies <br /> unique yard or setback regulations applicable to certain types of <br /> residential development <br /> 62.281 Side Yard Reduction: One side yard for a single family detached <br /> dwelling or duplex may be reduced below the requirement for side yard, <br /> least width, specified in the zoning district tables when the <br /> following conditions are met: <br /> 1) The sum of the reduced side yard and the opposite side yard shall <br /> meet or exceed the requirement for side yard, sum of least width, <br /> specified in the zoning district table for the applicable zoning <br /> district. <br /> 2) Where an existing dwelling on the lot adjacent to the reduced side <br /> yard is located closer than the requirement for side yard, sum of <br /> least width, specified for that use a minimum building separation <br /> of 12 feet must be maintained between dwellings. <br /> 3) Where an applicant is developing multiple adjacent lots under the <br /> regulations of. this paragraph, the minimum building separation <br /> between dwellings on adjacent lots under the applicants control <br /> shall be 10 feet. <br /> . 4) No dwelling developed under the regulations of this section shall <br /> be located closer than five feet to an existing accessory <br /> structure or garage on the lot adjacent to the reduced side yard. <br /> 5) The applicant shall record or cause to have recorded a covenant or <br /> deed restriction on all properties which abut the reduced side <br /> yard which provide for the establishment of an easement four feet <br /> in width adjacent to the structure (which may be split between the <br /> adjacent properties) , which shall provide 1) rights of access to <br /> the abutting property for the purpose of construction, <br /> reconstruction, repair and maintenance of the building with the <br /> reduced side _ yard; 2) provides for necessary encroachments of <br /> footings and eaves onto the adjacent property within the easement <br /> area. <br /> 6) No garage or other accessory structure shall be placed upon the <br /> easement area once established and recorded. <br /> 62.282 Cluster Development: The Cluster Development provisions are intended <br /> to provide an optional set of development regulations for owners who <br /> wish to create a subdivision utilizing common areas of land while <br /> retaining the overall density that would have been realized if the <br /> 138 - December 19, 1991 <br />
