3.372(l) Additional Fees. An additional fee as prescribed by Chapter 14 shall be due and <br /> payable for every required reinspection subsequent to the first reinspection <br /> • provided for in this section. <br /> 3.372(2) Continuing Violation a Separate Misdemeanor. In addition to the additional <br /> inspection fee for additional inspections for continuing violations, each period of <br /> ten days after the initial 60-day period of the violation shall constitute a new <br /> violation punishable as a misdemeanor hereunder. <br /> . . . . . . . . . . (Ord. 79-17, 94-21) . <br /> 3.373 Authori . Excluding appellate bodies, the Director of Fire and Safety shall be the final <br /> authority in the determination of a violation. <br /> 3.374 Inspection Access. If any owner, occupant, or other person in charge of a building or <br /> portion thereof fails or refuses to permit free access and entry to the structure or premises <br /> under his control for an inspection pursuant to this Dwelling Code, Director of Fire and <br /> Safety may seek a court order authorizing such inspection. <br /> 3.375 Compliance Order. Whenever the Director of Fire and Safety determines that any building <br /> or portion thereof or premises fails to meet the provisions of this Dwelling Code, he may <br /> issue a Compliance Order setting forth the violations and ordering the owner, occupant, <br /> operator, or agent to correct such violations. This Compliance Order shall: <br /> 3.375 (l) Be in writing; <br /> 3.375 (2) Describe the location and nature of the violations of this Dwelling Code; <br /> • 3.375 (3) Establish a reasonable time.for the correction of such violations; and <br /> 3.375(4) Be served upon the owner or his agent or the occupant. Notice shall be deemed <br /> to be properly served upon such owner or agent, or upon any such occupant, if <br /> a copy thereof is: <br /> 3.375(4) (a) Served upon him personally, or <br /> 3.375(4) (b) Sent by Certified mail to his last known address, or <br /> 3.375(4)(c) Upon failure to effect notice through(a)and(b)as set out in this subsection, <br /> posted at a conspicuous place in or about the dwelling which is affected by <br /> the notice. <br /> 3.376 Notice of Violation. If after the period allowed for compliance has elapsed, the Director <br /> of Fire and Safety determines on the basis of a re-inspection that the violation has not been <br /> corrected,a notice of violation shall be issued summoning the responsible parry into court. <br /> This citation shall reiterate the charge and the Dwelling code Section(s)violated. <br /> 4-4-.377 Emergency Cases. When a violation of this Dwelling Code constitutes an imminent peril <br /> to life, health, or property, the Director of Fire and Safety may require immediate <br /> compliance. When this is the case, no stay of proceedings in furtherance of action shall <br /> be granted on appeal. Situations which constitute an imminent peril to life, health, or <br /> property include, but shall not be limited to, the following: <br /> • 3.377 (1) Heating Systems. Heating systems that are unsafe due to: burned out or rusted <br /> out heat exchangers (fire box); burned out or plugged flues; not being vented; ' <br /> 3-34 072684 <br />
