3.378 (4) Hazardous Building Declaration. In the event that a dwelling has been declared <br /> unfit for human occupancy and the owner has not remedied the defects within a <br /> prescribed reasonable time, the building may be declared a hazardous building <br /> and treated consistent with the provisions of Minnesota Statutes, or, in the <br /> alternative, in compliance with Chapter 9. <br /> 3.379 Built-In Deficiencies. Certain specific deficiencies may be deemed to be beyond <br /> reasonable correction by the Director of Fire and Safety. Such deficiencies shall be limited <br /> to the following: <br /> 3.379 (l) Ceiling g eight. Any existing habitable room with less than a seven foot ceiling <br /> height shall be considered a built-in deficiency which is beyond reasonable <br /> correction. <br /> 3.379 (2) Superficial Floor Area. Any existing habitable room of less than ninety square <br /> feet shall be considered a built-in deficiency and beyond reasonable correction. <br /> 3.379 (3) Natural Light and Ventilation. Any existing habitable room with window area <br /> less than ten percent of the floor area shall be considered a built-in deficiency <br /> beyond reasonable correction but in no case shall the required natural light and <br /> ventilation be less than five percent of the floor area. <br /> . . .... . . . . . . . . . . . . . . . . . . . . . . . . . . . . Appeals from a Compliance Order issued by the Director of Fire and Safety <br /> pursuant to the Dwelling Code are governed by and subject to the provisions of Chapter <br /> 1. <br /> 3.382 Penalties. Any person who fails to comply with a Compliance Order after right of appeal <br /> has expired,and any person who fails to comply with a modified Compliance Order within <br /> the time set therein, and any person who violated any of the provisions of this Dwelling <br /> Code by doing any act or omitting to do any act which constitutes a breach of any section, <br /> shall be guilty of a misdemeanor. <br /> 3.383 Alternative Sanctions. In the case of commercial facilities which require licensing and <br /> multiple dwellings which require registration, said licensing or registration may be <br /> revoked, or renewal thereof withheld, until compliance with this Dwelling Code. <br /> 3 -36 072684 <br />
