I. Pursuant to the Waste Management Act, Kim. Stat. Ch. 115A (1982), the <br /> WNB is required to prepare an inventory of "preferred areas" of up to 10 <br /> square miles each for commercial hazardous waste processing facilities. The <br /> final inventory must include at least three areas* for each of the following <br /> categories of commercial hazardous waste processing facilities: (a) a chemi- <br /> cal.processinng facility, (b) an incineration facility, and (c) a transfer and <br /> storage facility. <br /> 2. On April 22, 1982, eight outstate (outside the seven-county 'Twin <br /> Cities metropolitan area) areas were placed on the WMB inventory of preferred <br /> areas for hazardous waste processing facilities.. All eight were designated <br /> for chemical processing, transfer/storage, and two of the eight areas were <br /> also designated for incineration. <br /> 3. On April 22, 1982, the Hoard also decided to further review the <br /> seven-county metropolitan area to determine if there were additional possible <br /> areas which could be included in the inventory. The reason for continuing, <br /> and intensifying the search in the metro area is that approximately two-thirds <br /> of the state's hazardous wastes are generated there. (428 Ex. P). <br /> 4. On May 27, 1982, the Board informed the Mayor of Roseville of its con- <br /> tinuing search for areas in the seven-county metro area. (VM Ex. W). <br /> 5. On September 14, 1982, the Board informed the Mayor of Roseville that <br /> it had tentatively identified an area within the city as a possible "prelimi- <br /> nary area" for a processing facility, and invited the city to send a repre- <br /> sentative to a September 23 meeting at the State Capitol, where the Board <br /> would select approximately 30 areas for further study. (WMB Ex. T). <br /> 6. On Sceptember 23, 1982, the Board designated the Roseville site, along <br /> with 27 other sites, as preliminary areas for use as a chemical processing <br /> facility, and/or a trarisfer and storage facility. (WMB ME. V). The city was <br /> formally informed of this selection on that date. (WMB Ex. W). The September <br /> 23, 1982 news release did not mention the Roseville site. (VM Ex. V). <br /> 7. On November 4, 1982; the Hoard met and adopted selection factors to be <br /> used in evaluating the preliminary areas. (WMB Ex. BB). <br /> 8. On November 9, 1982, a public information meeting was held in Rose- <br /> ville. Notice of the meeting was given by press release sent to the Roseville <br /> Sun, St. Paul Pioneer Press and Dispatch, The Minneapolis Star and Tribune, <br /> and various other newspapers and radio stations serving the Roseville area. <br /> (WNB Ex. Z). Articles appeared in the Pioneer Press,' Dispatch, Star and <br /> Tribune, Vadnais Heights-Little Canada Press, Roseville Sun and Roseville Re- <br /> view. (WMB Ex. IM). Approximately 125 people attended the meeting. (WMB Ex. <br /> 9. On December 16 and 17, the WMB met at the State Capitol to review the <br /> preliminary areas in light of information collected,at the various public in- <br /> formation meetings and assembled by the staff. The Mayor of Roseville testi- <br /> fied at the meeting requesting a reduction in the.proposed siting area. (ATB <br /> EK. FF)'. 'Dhe Board voted to reduce accordingly the proposed siting area, but <br /> tentatively included the reduced Roseville site for transfer/storage and <br /> chemical treatment facilities. NB 'Ex: FF). Of the 28 sites considered at <br /> that meeting, 16 were proposed as preferred areas, and 12 were eliminated from <br /> -2- <br />
