i <br /> • <br /> AGREEMENT FOR USE OF <br /> TRITON DOPPLER RADAR <br /> THIS AGREEMENT is entered into between the United States of <br /> America, Department of Commerce, National Oceanic and Atmospheric <br /> Administration, National Weather Service, hereinafter referred <br /> to as "NWS, " and the City of St. Anthony, Minnesota, hereinafter <br /> i referred to as "the Community. " In order to provide for the <br /> use of the Triton Doppler radar described in the specifications <br /> j attached hereto, hereinafter referred to as "the System" by <br /> the NWS Forecast Office (WSFO) , Minneapolis, Minnesota, the <br /> parties do hereby mutually agree: <br /> 1 . Upon the written notice from NWS referred to in paragraph <br /> 6 hereof, the Community will purchase the System and make <br /> arrangements for installation at the WSFO Minneapolis, MN. <br /> 2 . NWS will furnish suitable space and power for the System. <br /> 3 . NWS will monitor the System and attempt to use the information <br /> derived as an augmentation to NWS S-band radar capability. <br /> • 4 . Since the System is basically experimental in nature and <br /> has not been formally evaluated, the Community understands <br /> that improvement in severe storm detection capability may <br /> not necessarily derive from use of the System. <br /> 5. The Community releases the Government , its officers, agents, <br /> and employees, and the Government releases the Community, <br /> its officers , agents and employees , from liability of any <br /> nature or kind, including costs and expenses , for or on <br /> account of any or all suits or damages of any character <br /> whatsoever resulting from injuries or damages sustained <br /> by any person or persons or property by virtue of the use <br /> of the System. <br /> 6. At the end of a suitable period, a written test and evaluation <br /> report will be furnished to the Community by NWS. On or <br /> before September 1, NWS will give the Community written <br /> j notice of .acceptance o rejection of the System. Failure <br /> to give such notice s 11 be deemed acceptance of the System. <br /> 7 . This Agreement is eff tive upon signature by both parties <br /> and may be .amended or. modified at any time by mutual agreement <br /> of the, parties hereto . Either party may terminate this <br />
