Kavouras shall -indemni-fy and hold harmless the City and <br /> all of its councilmembers , officers, .agents . and employees , and the <br /> NWS and its- officers, agents and employees , from ,any -and all , <br /> losses , damages and expenses ( including -attorney' s fees ) relating <br /> to any claims , suits, actions or proceedings relating to the <br /> installation, operation or maintenance of the System by Kavouras , <br /> including any claims for injury, death to others or damage to <br /> property in the physical presence of the -System because of . defects <br /> in the System, or for� in:fringement of any patent, trademark or <br /> copyright . <br /> g. Kavouras shall retain ownership of the System until <br /> payment for the System by <br /> the City (the "Payment Date" ) . Until Kavouras shall carry and <br /> provide the City and NWS with evidence of statutory Worker ' s <br /> Compensation Insurance, public liability and property damage <br /> insurance in the amount of at least $1 ,000,000 for injuries . or <br /> death to any one person, $1,000,000 for injuries or death <br /> resulting from one accident, $1 ,000, 000 for property damage, and <br /> contractural liability insurance in the amount of at least <br /> $1 ,000,000 covering Kavouras 's indemnification of the City and NWS <br /> as set forth above. <br /> -3- <br />
