Violation of the <br /> law constitutes a misdemeanor and other state gambling laws apply as well. <br /> This law became effective May 3, 1984, but the Liquor Control Division is <br /> gearing up for July 1, 1984 licensing. <br /> GENERAL GOVERNMENT <br /> Cable commission membership <br /> Chapter 371 (S.F. 1475) allows a city council to be represented by a <br /> designee on a joint cable communication commission. Current law provides that. <br /> the city representative must be a council member. Effective Aug. 1, 1984. <br /> Duties and bonds of statutory city clerks <br /> Chapter 384 (H.F. 1503) provides that a statutory city council may by <br /> ordinance delegate all or part of the city clerk's bookkeeping duties to <br /> another officer or employee. The employee who the ordinance is makes <br /> responsible shall furnish a fidelity bond conditioned for the faithful <br /> exercise of his or her duties. The council may pay for the premium on the <br /> official bond from city funds. If the ordinance delegates bookkeeping <br />' functions of the clerk to the city treasurer, the council shall provide for an <br /> annual audit of the city's financial affairs. A copy of the ordinance must go <br /> to the state auditor. The act also clarifies the ability of statutory cities <br /> to buy blanket-position fidelity bonds, as well as individual bonds. Effective <br /> April 17, 1984. <br /> • <br /> Data Practices amendments <br /> Chapter 436 (S.F. 989) amends the data practices law by: <br /> defining "not public data" as government data which statute, federal <br /> law, or temporary classification classifies as confidential, private, <br /> nonpublic, or protected nonpublic; <br /> allowing responsible authorities to charge a reasonable fee in addition <br /> to the costs of making', certifying, and compiling copies of governmental data <br /> that has commercial value and is an entire formula, pattern, compilation, <br /> program, device, method, technique, process, data base, or system that <br /> required a significant expenditure of public funds. The responsible authority <br /> must provide sufficient documentation to explain and justify the fee; <br /> ' requiring, upon the request of any person denied access to data, the <br /> responsible authorities or designees to certify in writing that they denied <br /> the request and cite the specific statutory section, temporary classification, <br /> or specific provision of federal law which was the basis for denial; <br /> treating both private and confidential data as private data; <br /> clarifying the authority of government subdivisions to acquire <br /> z copyrights or patents for computer software programs or components of programs <br /> and treating such data as trade secret information; <br /> setting the expiration date of temporary classifications as 10 days . <br /> after the end of the second complete regular legislative session that follows <br /> the commissioner's granting of the temporary classification; <br /> classifying as nonpublic data the number of sealed bids a government <br /> agency has received; <br /> • prohibiting the release of payroll time sheets or other, comparable data <br /> if release of time 'sheet data would reveal the employee'.s reasons for the use <br /> of sick or other medical leave or other not public data; <br /> 1 <br />
