f
dr
-4-
1 In -recommending- approval of the variance; the .Pl.dnning Commission finds that:
2
3 1 . The subject'-property conforms to the City Ordinance requirement for total square
4 footage;
5
6 2. There was no opposition to the project from any of the neighbors and the two
7 most affected property owners had provided input on the location of the house;
8
9 . 3. The purpose of the proposed variance is not based exclusively upon the desire
10 of the owner to increase the value or income potential of the parcel of land;
11
12 4. The precedent for allowing substandard lots of a similar size had already been
13 established in the same neighborhood and the perceived hardship could be con-
14 sidered to have been caused by the City and not by persons having an interest
15 in the parcel of land.
16
17 Motion carried unanimously.
18
19 At 8:22 P.M. , the Chair opened the hearing on a petition from Ronald L. Hansen for
20 a variance to the City Ordinance sideyard setback requirements which would allow
21 the construction of a six foot addition to the existing one car garage on the west
22 side of the home at 2704 - 32nd Avenue N.E. , to within four feet, three inches, of
23 the property line, where 10 feet would be required by the Ordinance.
24
2D- The notice of the hearing which had been published in the October 2nd Bulletin
26 and mailed to all property owners of record within 200 feet of the subject pro-
27 perty, was read by Chair Zawislak. No one present reported failure to receive the
28 notice or objected to its content. The Manager reported receiving no calls from
29 the neighbors regarding the proposal and no one appeared to discuss the- request
30 other than the petitioner who is a member of the Planning Commission.
31
32 Commissioner Hansen had provided a sketch of the proposed addition as it related
33 to the existing house and the properties to the east and west of his home. He also
34 submitted a petition of approval of his plans which had been signed by all six of
35 the adjacent and abutting property owners. As he had shown on the sketch, the
36 Commissioner pointed out that only seven and a half feet of the proposed garage
37 addition would be adjacent to his west neighbor's free standing garage, which
38 exits, as his does, off 32nd Avenue N.E. and he indicated the Kalina home itself
39 faces Wilson Street N.E. and the remaining portion of Commissioner Hansen's garage
40 would face their backyard. The applicant reported there would be a corresponding
41 expansion of his existing family room on the back of his home, which would not
42 require a variance since it faces his backyard. The distance between eaves would
43 be just over seven feet, Commissioner Hansen estimated, which would be more than
44 between some of the new homes which are being built on Belden Drive, according to
45 the measurements he had taken.
46
47 - The Commissioner showed several, photos of his existing property which documented
48 the tangle of electric and cable lines and a tilting electric light pole on the
49 southern corner of his lot directly behind the proposed garage addition. He said
50 the utility company was going to move the pole they had mistakenly placed within
51 three feet of his property line, but had indicated they could do nothing about the
52 crooked pole which had been erected hastily in wet ground after the tornado. •
53 Commissioner. Hansen indicated he would be seeking staff help in correcting the
54 - situation; ideally with the installation of the- utilities underground.
55
