ANTHONY VILLAGE <br /> 3301 Silver Lake Road NE <br /> St. Anthony, MN 55418 <br /> RE: Evanson Property <br /> Planning Commission Meeting April 21 , 1987 <br /> Dear Commission Members: <br /> As an abutting property owner, I received notice of the hearing <br /> on the request by the adjacent property owner to be relieved from <br /> the requirement of platting as a condition of subdivision. I do <br /> not wish to add any conditions or delay the development of the <br /> Evanson land, but I must be guaranteed that the drainage conditions <br /> imposed when I built my home are completed in accord with the original <br /> plan. We have lived with the present condition since the construction <br /> of my home. The assurances by the City was that the building and <br /> grading conditions imposed upon me would be adhered to and carried" <br /> through to completion when the Evanson property was developed. <br /> Evanson, at that time, opposed the grading of the property with <br /> the result that when I constructed my home, I had to defend myself <br /> against lawsuits alleging I was depriving the owners of the Evanson <br /> property of his lateral support. They were opposing the grading <br /> and site conditions required of me by the City. The City was also <br /> sued as well as the property owner to the south, Dr. Osterbauer. <br /> With that background, the question to be considered by the planning <br /> commission is whether the present owner should be relieved of the <br /> platting and dedication requirements when there is a subdivision <br /> of property. I can appreciate that there should not be money expended <br /> unnecessarily; however, I understand the platting requirement is <br /> the procedure that ensures that all necessary easements and rights <br /> of way for surface water drainage and installation of utilities <br /> are appropriately dedicated and shown on the plat. This gives <br /> the City the right of access and entry to install and maintain <br /> the utilities to serve the properties. Platting procedures produce <br /> the information concerning how the grading of .the property will <br /> be accomplished to connect to the existing utility systems. <br /> J <br />
