ANTHONY <br /> i <br /> ORDINANCE' 1988-002 <br /> AN ORDINANCE RELATING TO THE <br /> REGULATION OF CONTROLLED <br /> SUBSTANCES; AMENDING THE 1973 CODE <br /> OF ORDINANCES TO ADD A SECTION <br /> The City Council of the City of St . Anthony hereby o.rdains : <br /> Section 1 . The St . Anthony 1973 Code of Ordinances is <br /> amended to add a new Section 964 to read as follows : <br /> Section 964 - Controlled Substances <br /> Section 964 : 00 . Controlled Substance Defined. For <br /> purposes of this Ordinance, "controlled substance" <br /> means a "controlled substance" as defined in Minnesota <br /> Statutes , Chapter 152 . <br /> Section 964 : 05 . Possession Defined. For purposes of <br /> this Ordinance, "possession" means having a controlled <br /> • substance on one' s person or in constructive <br /> possession including, but not limited to, constructive <br /> possession by an owner. of a motor vehicle, or by a <br /> driver of a motor vehicle if the owner is not present, <br /> who keeps a controlled substance in a motor vehicle or <br /> allows it to be kept in the motor vehicle . <br /> Section 964 : 10 . Prohibited Acts . No person shall <br /> manufacture, possess, constructively possess, sell, <br /> give away, barter, exchange, distribute, or otherwise <br /> transfer any controlled substance, except by way of a <br /> lawful prescription by a person licensed by law to <br /> prescribe 'and administer controlled substances . <br /> Section 964 : 15 . Exceptions . Section 964 : 10 does not <br /> apply to the following in the ordinary course of their <br /> lawful trade, business, or profession, but this <br /> Section is not a defense to violations of Section <br /> 964 .20 : <br /> (a) Practitioners and other persons licensed by <br /> law to prescribe and administer controlled <br /> substances . <br /> (b) Pharmacists duly registered and licensed <br /> with the Minnesota State Board of Pharmacy. <br /> ' J <br />
