5 . The Settling parties are Minnesota Transfer Railway <br /> Company, a Minnesota corporation, and Walburn Partnership Limited <br /> (collectively "Settling Parties") . The Settling Parties are the <br /> past and present owner of the "Trio Solvent site. " <br /> B. Consideration <br /> 6 . The Settling Parties shall pay Releasors $82, 500. The <br /> payment shall be made within 30 days of Court approval of this <br /> Agreement. The monies shall be paid to Briggs and Morgan's trust <br /> account. <br /> 7 . The settlement proceeds shall not be paid to Releasors, <br /> or to Briggs and Morgan or Leonard, Street and Deinard as <br /> attorneys' fees. The settlement proceeds shall be used to pay <br /> disbursements related to this case and for the investigation and <br /> analysis of the New Brighton/St. Anthony contamination pollution <br /> problem. <br /> C. Pierringer Release <br /> 8 . The Releasors claim to have sustained damages arising <br /> out of the alleged ground soil and water contamination and <br /> pollution in the New Brighton/St. Anthony area of Minnesota. The <br /> Settling Parties are claimed to be associated with the New <br /> Brighton/St. Anthony area-wide pollution. The Releasors have <br /> asserted claims against the Settling Parties for the payment of <br /> 4 - <br />
